The judge emphasized that probation requires strict rule-following and responsible behavior. Given Bushnell’s repeated misconduct while already under supervision in a controlled environment, the court questioned his ability to comply with probation conditions in the community. As a result, the judge rejected the previously negotiated plea agreements and reset the case for further review.

At a later hearing, despite clear instructions from the court to avoid further disciplinary issues, Bushnell received 11 additional write-ups involving similar rule violations. The judge determined that Bushnell failed to demonstrate improvement or accountability and again refused to accept any probation agreement. The court warned that if the case proceeds to trial, a jury will be permitted to review the disciplinary history, which could significantly impact sentencing outcomes. The charges carry potential prison exposure of up to 20 years.

Bushnell chose to retain his current court-appointed attorney, and the case has now been placed on the trial docket for jury consideration.
