Federal law grants residential homeowners (1-4 residential units) certain rights in regard to federally regulated mortgages. One such right is to get two copies each (for each borrower) notifying them of their 3-day right of rescission. This is a TILA requirement. Where Federal Truth in Lending ("TILA") violations are present, material violations, the borrower will have an extended three-year right to cancel or rescind the loan. Certain requirements must be met, one of the biggest ones being you have to have some basis to tender the loan balance you received, and this is something you need to discuss with a real estate lawyer like Attorney Steve. Hope you enjoy this video. Realize there are other mortgage violations under TILA (ex., under-disclosing the APR) that can also trigger the right to rescind.
