An 18-year-old defendant pleaded guilty to third-degree felony deadly conduct after firing an AK-47 into a multi-family apartment complex. According to court records, five shots were fired, striking three separate apartment buildings. Shockingly, three young children were playing outside in the area when the gunfire erupted.
The defense asked the court for deferred adjudication (probation), arguing that the defendant was young, had no adult criminal history, and deserved a second chance to turn his life around. They emphasized his difficult upbringing, lack of education, and potential for rehabilitation.
However, the prosecution painted a much darker picture. This was not a one-time mistake. The defendant had prior juvenile offenses, including unauthorized use of a motor vehicle and weapons-related charges. Prosecutors argued that the level of violence — including firing an assault-style rifle toward occupied apartments — showed extreme recklessness. They stressed that the community was “lucky we’re not dealing with murders.”
The most intense moment came when the judge highlighted that this case could have easily resulted in capital murder charges had anyone been killed — especially the children present. The judge questioned the defendant’s lack of visible remorse and ultimately rejected probation, sentencing him to the full five years in the Texas Department of Criminal Justice.
An affirmative deadly weapon finding was also entered, which carries significant consequences for parole eligibility.
This case raises serious questions about youth, accountability, public safety, and whether rehabilitation should outweigh punishment when innocent lives are placed at risk.
