Hello and welcome to another episode of our new series, Immigration Now with your host Ali Zaidi a Senior Immigration Solicitor at Zaidi Solicitors. Today I wish to discuss how to challenge Immigration detention at Yarl's Wood IRC.

If you are being detained at Yarl's Wood IRC it may be that you have no leave to remain in the UK or you have breached your conditions of stay. If this is the case you are liable to be detained and removed from the UK.

Before making an application for Immigration Bail you should send representations to the UKBA requesting Temporary admission. In most cases it has become UKBA policy to refuse applications for TA and therefore it becomes necessary to apply for Immigration Bail.

In certain circumstances you should make an application for leave to remain and then apply for Immigration Bail. Please take note that in accordance with the UK Immigration rules you should not be removed from the UK until your application has been fully determined by the UKBA.

If you are liable to be deported then you have 28 days to submit reasons why you should not be deported, however you only have 5 days to appeal if you are in detention.

You may appeal on Article 8 grounds if your right to a private and family life has been infringed. For example if you have established close family and private ties in the UK any removal may engage your rights under Article 8 of the Human Rights Act and ECHR. Also you are entitled to remain in the UK during the appeal process
