📱 WHAT TRAVELLERS NEED TO KNOW ABOUT DEVICE SEARCHES

The Australian Border Force (ABF) has legal powers to examine goods at the border - including electronic devices like phones, laptops, and tablets.

⚠️ Under Section 186 of the Customs Act 1901, Border Force officers may examine any goods subject to customs control, which includes documents stored on mobile phones, SIM cards, laptops, and computers.

🔍 WHAT CAN THE AUSTRALIAN BORDER FORCE (ABF) DO? 
✅ Question travellers about their belongings 
✅ Examine electronic devices 
✅ Read documents and photos on phones 
✅ Detain devices for forensic examination (up to 14 days)
✅ Copy data if they suspect it contains information about: 
• Prohibited goods 
• Offences under the Customs Act 
• Security matters 

❓ CAN YOU REFUSE A SEARCH? 
⚠️ Yes, BUT refusing may result in: 
• Detention by Border Force 
• Further law enforcement action 
• Delayed clearance

📋 IMPORTANT:

You do NOT need to be present when documents are copied by Border Force
If allowed to enter or leave Australia after a search, meaning that they found nothing that's subject to Customs' control or a breach of an offence under the Crimes Act, you could then apply to have stored data deleted
Any Commonwealth agency may access the copied data
You can raise concerns with the officer or supervisor at the time of questioning or examination
You can provide feedback through the Department of Home Affairs website

This applies to ALL travellers - both Australian citizens and non-citizens - arriving at or departing from Australian borders.
