Did you know that parents in India can legally take back their property?

We often hear heartbreaking stories where elderly parents are abandoned, thrown out of their own homes, or sent to old-age homes even after transferring their property to their children.

As painful as this reality is, Indian law offers strong protection to senior citizens.
Under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, parents can reclaim property that they transferred to their children under certain conditions.

Here’s what the law says 👇
If a senior citizen transferred their property after 29 December 2007, through a gift or any other means, on the condition that the receiver would provide basic necessities like:
Food
Clothing
Shelter
Care and maintenance
…and the receiver fails to fulfill this condition, the transfer can be declared void.

The law treats such transfers as having been made through fraud, coercion, or undue influence.
More importantly:
Every senior citizen has a legal right to maintenance.
This right can even be enforced against the person who received the property provided:

✔️ The receiver had notice of the obligation
✔️ The property was transferred without monetary consideration

And if a senior citizen is unable to take action themselves, organizations empowered under the Act can initiate proceedings on their behalf.
This law exists for one reason.
