Under PA’s tort system, you MUST elect either limited tort or full tort with your auto insurance. Insurance companies often convince their insureds to buy the cheaper limited tort option to “save money,” but never explain what it actually is and what they’re giving up for those savings.

Under the limited tort option, you waive your right to sue for pain and suffering after a car wreck unless you suffer a “serious injury.” But the courts haven’t actually defined “serious injury.” Rather, they’ve simply said a “serious injury” is one that has a serious effect on the injured person’s life. It’s a completely subjected standard, much like beauty is in the eye of the beholder.

Don’t waive away your rights to save a few bucks on your insurance. Your rights are worth soooo much more than the small savings you’ll get with limited tort.
