Here's what you need to know:

If your crypto sits dormant on a custodial exchange (e.g., Coinbase or Kraken) for 3 years—no logins, trades, deposits, or responses to emails—the platform must transfer it to the state if your address is in CA. (NOTE: Exchanges must warn you 6-12 months in advance.) The state then acts as custodian, holding your assets in their native form (Bitcoin stays Bitcoin) to “prevent forced sales during market lows or unwanted taxes.”

You would need to reclaim them via the State Controller's Office by verifying your identity, before potential sale 18-20 months post-transfer.

This mirrors rules for bank accounts or stocks. It applies only to exchange-held assets, not your personal wallets.
