New York State Rifle & Pistol Association v. Bruen, 142 S.Ct. 2111 (2022)

The Supreme Court considered the Second Amendment in New York State Rifle and Pistol Association versus Bruen.

New York law prohibited possession of a firearm outside one’s home or place of business without a license. A law-abiding adult could usually obtain a limited license restricted to hunting and shooting at a gun range. But someone wanting an unlimited carry license had to demonstrate proper cause for it. State courts defined proper cause as a special need for self-protection beyond that of the general public. Generally, an applicant had to demonstrate particular or recurrent threats, attacks, or extraordinary danger.

Brandon Koch and Robert Nash, two members of the association, applied for unrestricted carry licenses. Licensing officials denied their applications, offering them only restricted licenses.

The association sued Kevin Bruen, Superintendent of New York State Police, alleging that New York’s law violated their Second and Fourteenth Amendment rights. The district court dismissed the complaint, and the Second Circuit affirmed. The United States Supreme Court granted cert.
