Yesterday the Union Home Minister Amit Shah introduced a 3 new bill in the Lok Sabha.
The bill is about automatic removal of the Prime Minister, Chief Ministers, and Central or State Ministers if they are arrested for 30 days or 5 years jail ordered.
What is this new bill and why is it introduced ? Let me explain.
According to this new bill, if a minister is detained or arrested in such a case for 30 days, on the 31st day they will not be in power.
The bill also applies to Prime Ministers, Chief Ministers, Union Ministers, State Ministers and all MLAs.
For example : In 2023 Tamil Nadu minister V. Senthil Balaji, who was arrested in a money laundering case.
He was in jail and still he was a minister in Tamilnadu.
After his arrest, Tamil Nadu Governor R.N. Ravi removed him from office, but the Chief Minister reappointed him once he got bail.
This new bill was introduced because there is no proper explanation of what if a representative made a mistake.
This bill changes Article 75 of the Constitution.
However, the bill has now been sent to a Joint Parliamentary Committee (JPC).
The committee is expected to submit its report on the first day of the next Parliament session.
Opposition parties have been invited to submit their complaints before the committee.
Opposition parties have strongly criticized the bill.
They said, this law could be misused.
Arrests are being used as tools for the ruling party against the opposition party.
For example Arvind Kejriwal, arrested while serving as Delhi Chief Minister.
Hemant Soren, arrested as Jharkhand CM.
Their arrests were labeled by critics as politically motivated.
But they stayed more than 30 days which means they have loose power for fake cases.
So this needs to be more clear.
