A York County judge has declared a mistrial in the murder case of a 10-month-old baby because of the absence of a key witness—Detective Mark Baker, who was shot and killed during the ambush in North Codorus Township on Sept. 17.

Legal experts anticipate that this will be the first of many cases where a similar situation may arise.

"When you do have something where there is loss, then you deal with it individually and you evaluate each case on a case-by-case basis," said Fran Chardo, Dauphin County District Attorney.

The decision to declare a mistrial came one day after the deadly shooting took the lives of three Northern York County Regional detectives and injured two other officers.
