According to records from the Supreme Court of Judicature of Jamaica, Civil Division, under Claim #: 2015HCV04402, the court issued a Summary Judgment regarding a claimant, Owen Witter, who had not yet reached the age of 65 at the time of the judgment. The two defendants appeared to act in collusion, contrary to pre-established fiduciary rules.
This information is now public. For thoroughness and clarity, we will examine the first six pages of the Summary Judgment to aid in my analysis.
Analysis and Outlook
Based on the aforementioned case, it appears that much has already been lost. Many of you may have drawn similar conclusions even before the Supreme Court’s review. However, Mr. Owen Witter’s unwavering pursuit of justice is the reason I am standing before you today. While some have waited on the sidelines, the time has come for collective decision-making—whether to end the matter here or continue the fight for justice.
The Supreme Court’s summary judgment, though limited in scope due to the evidence and legal arguments permitted, serves as both a challenge and a roadmap for moving forward. The initial outcome favored the defense, but not all is lost. There remain two critical factors for future success:
• Whether the claim is statute-barred—do these rules apply when some vested pension plan members have not yet reached or are approaching the retirement age of 65?
• Whether the Board of Trustees acted legally.
