Bloomberg recorded and transcribed a conference call hosted by Swatch Group without authorization and made it available to its paid subscribers. Swatch Group's subsidiary, Management Services, filed a complaint for copyright infringement. The court ruled that the authorized audio recording of the call is entitled to copyright protection, and the copyright claim is properly registered. The court also discussed the requirements for copyright owners of a work consisting of sounds, images, or both, to serve notice upon the infringer before the first fixation is made simultaneously with its transmission.
