Adjustment to 95% Occupancy - Many tenants are confused about the idea to adjust operating expenses up to reflect their building being 95% occupied even if the occupied portion of their building is less than this 95% threshold. While not the only reason, this is done to prevent an unexpected spike in operating expense costs to the tenant when the building does become fully occupied (or close to it) and variable operating expenses naturally increase due to the higher occupancy rate. As a tenant, make sure this adjustment is applied to your base year to avoid large spikes in your operating expenses throughout the term of your lease.
