When a person or business files for bankruptcy, it’s important to understand the relationship between taxes and bankruptcy. Tax debt is treated differently depending on the type of bankruptcy being filed. For example, in a Chapter 7, some tax debts may be dischargeable, meaning that they’re wiped out by the bankruptcy. The general rule is that the tax debts must be more than 3 years old, and the tax returns filed at least 2 years prior to the bankruptcy filing. But there are many caveats to those rules that may make the tax debt non-dischargeable
