History & Background:
We built our existing wooden fence about 10-12 years ago. We used 6 foot (72 inches) dog-eared plank pickets, 4x4x8 pressure treated wood as posts and 2x3x8 as horizontal railing. The fence would've lasted us many more years if not because the person who purchased next door property (after it was burned down and condemned by the town Fire Marshall), piled junks and stuffs against our fence. During the winter and rainy season, when the ground is soft, the fence would lean because of the heavy stuffs piled against it.

Evidently, the owner was a pack rate. The property became a "junk yard". More and more junks were brought in and put in the property. A few years later, the town ended up owning the property. We're speculating either he passed away or he didn't pay his property taxes and therefore the city ended up owning the property. They came and boarded up the place.

Anyways, some section of the fence came down because either the planks were broken or the post couldn't handle the weight. The junks on the property became an eyesore to us, our guests and visitors. We complaint to the city but there was no action. They did sent a few sub-contractors to try to clean up the place, but all they did were to re-pile the stuffs against our fence. Scavengers loiterers came to from time to time to get scraps and made more mess.

So we decided to rebuild our fence. Our main goal this time around is to make sure the fence would withstand similar abuse, should another owner end up buying the property and do the same. We figured that using cinder block wall as a foundation for the picket fence would be the best solution.

The plan was to build the foundation for the fence similar to retaining wall using concrete cinder blocks about 2 feet or 24 inches higher than the ground. We would then insert 4x4 post every 8 feet, install the horizontal railing using 2x4x8, and then screw or nail in the 6-feet high vertical dog-eared picket planks.

State building codes and municipal zoning regulations varies in terms of maximum fence height allowable. In our state, the max height is 6 feet for residential fencing. Fences that do not obscure the vision of motorists or pedestrians may be built to a height of eight feet. Other types of fences, walls, or hedges shall be no greater than six feet in height.

For our town, fences, walls, privet hedges, or berms cannot be more than seven (7) feet in height in any side or rear yard from the lowest ground. Our backyard sloped downward to the rear. To circumvent lowest ground stipulation, we planned to add another retaining wall in the front and backfill with dirt.
