I had a follower ask a great question the other day: What is the difference between accepting a plea offer and entering pretrial diversion.

A lot of people are confused by this. The criminal justice system can be confusing if you are not a regular participant in the system. This video explains the difference between a plea and pretrial diversion in criminal law cases.

A plea resolves a criminal charge and pretrial diversion avoids a criminal charge. Pleas are punitive in nature whereas pretrial diversion focuses on getting the defendant out of the criminal justice system. Pleas can have fines, jail time, and other sanctions. Pretrial diversion is a program that when completed, the state will dismiss or nolle pros the case. A plea can come with or without an adjudication. A pleas can involve a lesser charge or the actual crime as charged.
