CAMPBELL COUNTY, Ky. (Brad Underwood) -- Forty years in prison. That was the sentence handed down Friday night, August 14, for Shayna Hubers who shot and killed her ex-boyfriend, Ryan Poston. Her lawyers tried to get her a lighter sentence claiming she was a victim of domestic violence. The judge didn't buy it; Judge Fred Stine didn't buy it for a minute. He said there was no evidence to back up the defenses claims that Hubers and Poston were an "unmarried couple" or lived together, shared finances or shared anything for that matter and denied the motion for lighter sentence. Before the sentencing Hubers friends and a doctor testified. Late into the evening the defense attempted to play video testimony but Judge Stine ruled against that too and said he had heard enough and was ready to rule. Before he did he made sure Hubers knew that he wasn't happy about her demeanor and lack of remorse throughout the trial. "What happened in that apartment was a little more than cold blooded murder. It's probably as cold blooded of an act that I've been associated with in the criminal justice system in the 30 plus years I've been in it," Judge Stine said. After hearing her sentence, like much of the entire trial, no remorse was shown on Hubers' face. She did at one point mouth something to her family in the courtroom before being taken away to prison. After the sentencing, Ryan Poston's family was still disgusted with how Hubers carried herself during the trial and not once did she express sympathy or regret for killing Poston. "Whatever she could say, whatever they could try and throw out to see if something would stick. And nothing did. Nothing ever will because Ryan wasn't that kind of person and I think everyone knows what kind of person Jay, Lisa and brought up," said Ryan Postons step-father, Peter Carter. "I think it's very clear that she's not remorseful. She showed her true self in court. It's the Shayna Hubers we knew and now it's the Shayna Hubers everybody else knows," said Michelle Snodgrass, Campbell County Commonwealths Attorney The 40 year sentence was the term recommended by the jury. While Judge Stine agreed to it, he did say he was tempted to give her more time than the recommendation. The defense asked for 20 years. Hubers will get credit for time already served.
