Subscribe to my personal channel for videos on how to study law effectively & efficiently:    / @heygarethevans   The “1925 property legislation” refers to six statutes (Law of Property Act 1925; Trustee Act 1925; Settled Land Act 1925; Land Registration Act 1925; Administration of Estates Act 1925; and Land Charges Act 1925) which together fundamentally altered domestic property law. Among other things, the 1925 property legislation reorganised the impact of equitable (NB not legal) rights in rem on transferees of unregistered land by dramatically reducing the influence of notice.

So the property legislation dealt with the position in respect to equitable rights in rem due to the unsatisfactory nature of the doctrine of notice. The pre 1926 legislation was fairly satisfactory for legal rights in rem – it still automatically binds transferees!

This was achieved by two devices:
i. A scheme of “land charge registration”
ii. The doctrine of statutory overreaching
