When a Police officer does not Register an FIR on occurrence of any cognizable offences then the complainant reserves a right to take action against such a Police officer under the section 166 and 166(a) of the Indian penal code. The Police officer when fails to register an FIR against such offences shall be held liable for such an act with a punishment of imprisonment for 6 months which may extend upto 2 years and shall also be liable to a fine. Majority of citizens of India are unaware of this provision wherein they can invoke their rights in cases of non registeration of FIR against congnizable offences.
Section 166 in The Indian Penal Code
166. Public servant disobeying law, with intent to cause injury to any person.—Whoever, being a public servant, knowingly diso­beys any direction of the law as to the way in which he is to conduct himself as such public servant, intending to cause, or knowing it to be likely that he will, by such disobedience, cause injury to any person, shall be punished with simple imprisonment for a term which may extend to one year, or with fine, or with both.
166A. Whoever, being a public servant—knowingly disobeys any direction of the law which prohibits him from requiring the attendance at any place of any person for the purpose of investigation into an offence or any other, or knowingly disobeys, to the prejudice of any person, any other direction of the law regulating the manner in which he shall conduct such investigation, or fails to record1 any information given to him under sub-section (1) of section 154 of the Code of Criminal Procedure, 1973, in relation to cognizable offence punishable under sections:
326A Voluntarily causing grievous hurt by dangerous weapons or means.
326B Voluntarily causing grievous hurt by use of acid.
354: Whoever assaults or uses criminal force to any woman, intending to outrage or knowing it to be likely that he will thereby outrage her modesty.
354B: Any man who assaults or uses criminal force to any woman or abets such act with the intention of disrobing or compelling her to be naked.
370 Buying or disposing of any person as a slave.
370A Exploitation of a trafficked person
376 Punishment for rape
376A Punishment for causing death or resulting in persistent vegetative state of victim.
376AB :commits rape on a woman under twelve years of age.
376B Sexual intercourse by husband upon his wife during separation.
376C; Sexual intercourse by a person in authority.
376D: Gang rape.
376DA; Punishment for gang rape on woman under sixteen years of age
section 376DB- punishment for gang rape on women under 12 years of age.
section 376E- punishment for repeat offenders.
section 509- insult the modesty of women through word ,gesture .
shall be punished with rigorous imprisonment for a term which shall not be less than six months but which may extend to two years, and shall also be liable to fine.
