Pretrial diversion programs are intended to help qualifying California defendants to avoid a criminal conviction, by treating their underlying mental conditions, drug addictions, and/or conditions related to their military service trauma.

There are generally three types of criminal defendants who qualify for pretrial diversion:

1.) Drug addicts who qualify for drug diversion under Penal Code PC 1000 (PC 1000). This is generally for low-level drug offenses such as drug possession or marijuana cultivation.

2.) People who suffer a severe mental disorder and qualify for mental health diversion under Penal Code 1001.36 PC. Qualifying mental health disorders include schizophrenia and bipolar disorder.

And 3.) Service members who qualify for military diversion or veterans diversion under Penal Code 1001.80 PC . This is for current or past military members who are suffering from post-traumatic stress disorder (PTSD), traumatic brain injury (TBI), drug addiction, mental health problems, or sexual trauma.

The benefits of pretrial diversion are that you do not have to enter a guilty plea or a no contest plea, and the case gets completely dropped. On top of that, the court will automatically seal your criminal record so that the case will no longer appear on your background check.
