This is big news if you trade crypto in the U.S.

On September 2, 2025, the SEC and CFTC made a joint announcement under the SEC’s Project Crypto and the CFTC’s Crypto Sprint. They said that there is no law stopping registered U.S. exchanges from offering leveraged, margined, or financed spot crypto transactions.

What this means you can do soon:

You will be able to use spot margin trading legally on U.S.-regulated exchanges (think Coinbase, Kraken, or Nasdaq-linked platforms once they implement it).

You can borrow funds to increase your buying power, most likely up to about 2x, maybe 3x or 5x depending on the exchange and your account type.

You will own the real crypto you buy with that borrowed money. If you buy Bitcoin on margin, it is real BTC that can be withdrawn as long as you meet collateral requirements.

You will pay interest on the borrowed amount, usually daily or hourly, just like a margin account for stocks.

There is no expiration date, you hold until you sell, or until the exchange liquidates part of your position if your equity gets too low.

What you still cannot do:

You cannot trade perpetual futures (perps) or other derivatives with 10x, 25x, or 100x leverage on unregistered platforms if you are in the U.S.

BitMEX-style contracts are still regulated as derivatives. Any platform offering them to U.S. customers would need to be a CFTC-registered derivatives exchange (like CME).

High leverage trading for retail traders (25x, 50x, 100x) is still unlikely to be approved due to investor protection rules.

The key difference is that spot margin trades involve real assets — you are buying actual Bitcoin or Ethereum with borrowed money. Perps are synthetic contracts — no real coins are bought or sold, and they are treated under U.S. law as derivatives that require full CFTC oversight.

So bottom line: You soon will be able to legally do 2x spot margin trades on U.S. exchanges without a VPN or offshore account. But you still cannot do high-leverage perps unless you are using a fully registered derivatives platform, which most retail traders do not have access to.
