All species of birds encountered in the wild in Georgia are protected by state and federal laws except English sparrows, European starlings, and pigeons. Birds not otherwise regulated as a game bird, a nuisance species, or a threatened or endangered species are protected under the Migratory Bird Treaty Act. We start by assessing the area and identifying the woodpecker holes. We then carefully inspect each hole to check for any signs of nesting birds or eggs. If we find any, we postpone the hazing services until the birds have left the nest and it's safe to proceed with control measures.

In this case our inspection camera found there to be an active nest with at least 4 eggs. We suspect it is a Wren's Nest based upon the size and color of the eggs. So we ethically cannot setup hazing electronics to scare off woodpeckers because it will also affect the Wrens. We cannot risk impeding the hatching of these eggs so we will advise the client that we just need to wait for a short period before hazing the woodpeckers.
