Fulton County District Attorney Fani Willis can remain on the Georgia election interference case against Donald Trump as long as special prosecutor Nathan Wade with whom she had a romantic relationship steps aside, the judge overseeing the case ruled Friday.

The ruling from Judge Scott McAfee comes after an attorney for co-defendant Michael Roman — a former Trump White House aide — filed a challenge to have Willis removed from the case, alleging there was a conflict of interest because she hired Wade for financial benefit.

Fulton County Superior Court Judge Scott McAfee said he did not conclude that Willis' relationship with special prosecutor Nathan Wade amounted to a conflict of interest. However, he said, it created an “appearance of impropriety” that infected the prosecution team.
