Parental Rights ARE Constitutional Rights

Did you know the Supreme Court has repeatedly affirmed your right to raise your child without state interference—unless you’re proven unfit?

From Pierce v. Society of Sisters (1925) to Troxel v. Granville (2000), the Court made it clear: fit parents—not the government—decide what’s best for their kids.

Yet today, family courts routinely sidestep these rulings. Judges often override fit parents using vague “best interest” standards. But the Constitution says fitness comes first—not judicial opinion.

In Troxel, the Court ruled: so long as a parent adequately cares for their children, there will normally be no reason for the State to inject itself into the private realm of the family.

That means:

A fit parent’s choices must be presumed valid
The state must prove actual harm before interfering
Constitutional claims must be respected in court

Parents: assert your rights early. Document violations. Insist your attorney raises federal constitutional case law. If they won’t, find one who will—or bring in a civil rights lawyer.

Family courts are not above the Constitution. Judges must stop substituting their judgment for that of parents without meeting strict legal standards.

It's time to hold the system accountable. These aren’t just family issues—they’re constitutional ones.
