About the Program
Whether it’s as a covered entity or a public health authority, public health departments encounter thorny HIPAA-permissible-use-and-disclosure questions daily. Such questions arise, for example, around when a health department that is a covered entity may use or disclose protected health information (PHI) for communicable disease investigations, research, or even emergency preparedness and response. Permissible use and disclosure questions also come to the surface when a public health department seeks to access public health data from HIPAA covered entities, such as in a hepatitis or food-borne illness outbreak investigation.
