Nicole: I was just curious how hard it is to relocate a child from the state that they live in.
Attorney Tom Olsen: Here in the state of Florida, if you want to leave the state of Florida with your child you've got custody; of course, you have to get court permission to do so. And to get court permission, you have to give the court a good reason. So if you got a better job offer, if you've remarried and your spouse needs to move to another state. Those are all good reason. You want to move closer to a relative, that's a good reason. Hey, if you want a change of scenery, that's not a good reason.
Nicole: No, my husband has been promoted and their relocating him to another state and I want my older son to come with me and I have custody. And I was just wondering how difficult that would be.
Attorney Tom Olsen: Then, Nicole, everything that I know of says that that is entirely possible. Of course it's going to have something to do with how hard the natural father puts up an argument here, but as far as I know, Nicole, that is a legal reason for you guys to do so. But you must have a court order first. Nicole, Paul Noonan is fame and law divorce attorney in my office. And Paul, just like all of the lawyers in my office is always happy to give people a few minutes of free legal advice right over the phone.
