There can often be disputes regarding the terms of a will. Perhaps circumstances have changed regarding a beneficiary named in a will or regarding a particular asset. Perhaps there is an ambiguity in the interpretation of the particular words used by the testator.

How are such disputes resolved? Very often by the filing of a declaratory judgment action. This is a form of a lawsuit where one or more persons can ask a court to make a ruling regarding the interpretation of a particular document, including a will. The Texas Declaratory Judgment Act is found in Chapter 37 of the Texas Civil Practice and Remedies Code.
