When Can Grandparents Get Custody?

One question we often get asked is when grandparents can get custody of the children. The short answer is that on paper, grandparents do not have any rights to the grandchildren under North Carolina law. However, there are exceptions in which the grandparents can make a motion to intervene during an ongoing custody case due to the parents being unable (unfit) to care for their children due to drug addiction or mental illness. These criteria are explained in detail in the video.
