The Free State High Court in Bloemfontein is hearing Moroadi Cholota's urgent application today to have her arrest declared unlawful and unconstitutional. The former personal assistant to the then Free State premier Ace Magashule argues that the R255-million asbestos corruption and fraud charges against her emanate from her refusal to comply with the state demands for specific testimony on the case.

The 37-year-old is asking the court to deem the charges against her invalid and to withdraw them.
Cholota is out on R2 500 bail following her extradition from the USA.

Legal analyst Elton Hart joins us via video link to unpack Cholota's bid to declare her arrest unlawful.
