Waiver of Liability and Release Agreement**
*Parties:*
This Comprehensive Waiver of Liability and Release Agreement ("Agreement") is entered into by and between @NMCopWatch, @NM505CopWatch (collectively referred to as "Releasees") and the undersigned viewer or user ("Releasor").
*1. Purpose:*
The purpose of this Agreement is to absolve the Releasees of any liability associated with the dissemination, viewing, and use of video content published on their platforms, specifically content involving law enforcement and public interactions.
*2. Acknowledgment and Voluntary Participation:*
Releasor acknowledges that they are voluntarily choosing to view the content provided by Releasees, which may contain graphic and potentially disturbing scenes of real-life interactions involving police and public incidents. Releasor understands the nature of the content and willingly assumes all risks associated with viewing such content.
*3. Assumption of Risk:*
Releasor agrees to assume all risks related to and arising from viewing the content, including but not limited to emotional distress, psychological impact, and triggering of personal trauma. Releasor acknowledges that the content may have lasting effects and agrees to bear full responsibility for any reactions or actions taken as a result of viewing the content.
*4. Release and Waiver of Claims:*
Releasor hereby releases, waives, and forever discharges Releasees from any and all liabilities, claims, demands, expenses, fees, fines, penalties, suits, proceedings, actions, and causes of action of any and every kind, whether known or unknown, in law or equity, that Releasor ever had, now has, or hereafter can, shall, or may have against Releasees for, upon, or by reason of any matter, cause, or thing whatsoever arising out of or related to Releasor's viewing of the content.
*5. Indemnification:*
Releasor agrees to indemnify, defend, and hold harmless the Releasees from any and all claims, liabilities, damages, losses, costs, and expenses, including but not limited to attorneys' fees, resulting from any violation of this Agreement or any activity related to Releasor's viewing of the content (including negligent or wrongful conduct).
*6. Governing Law:*
This Agreement shall be governed by, and construed in accordance with, the laws of the State of New Mexico, without giving effect to any choice of law or conflict of law rules.
*7. Severability:*
If any term, clause, or provision of this Agreement is declared illegal, unenforceable, or ineffective in a legal forum, such a declaration shall not affect the enforceability of the remaining portions of this Agreement.
*8. Entire Agreement:*
This document constitutes the entire agreement between the parties regarding the matters discussed herein and supersedes all prior discussions, agreements, or understandings of any kind.
