Several federal equal employment opportunity (EEO) laws prohibit discrimination in all aspects of employment, including employee benefits, for protected classes such as race, color, sex, religion, national origin, age, and disability. The Equal Employment Opportunity Commission (EEOC) enforces these laws and handles claims filed by individuals who believe they’ve been discriminated against or retaliated against for EEO involvement. Each law has specific coverage requirements, including the Equal Pay Act of 1963, which amends the Fair Labor Standards Act (FLSA) to address wage discrimination.

The Equal Pay Act was created to correct the outdated belief that men should be paid more than women for doing the same job.
It applies to the same employers covered by the FLSA and is enforced by the U.S. Department of Labor. The law requires that men and women receive equal pay and benefits for equal work. The EEOC defines wages broadly to include all forms of compensation, including employee benefits. Pay must reflect the job's skill, effort, responsibility, and working conditions—factors considered in determining equal work.
