Key Officials In Municipal Administration are appointed in terms of the Municipal Systems Act and are responsible for various administrative tasks which include the role of implementing planned policies and strategies and ensuring the smooth running of the municipality’s functions.

A municipal manager is a person appointed by the Municipal Council in terms of the Municipal Structures Act & the Municipal Systems Act. Section 82 Municipal Structures Act & Section 54A of the Municipal Systems Act

The appointment of a municipal manager must be for a fixed term & limited to a maximum period of five years. Section 57(6) of the Municipal Systems Act

The person appointed as a municipal manager, or acting as a municipal manager is considered the head of the administration of the municipality & also the accounting officer of the municipality.
Section 82 Municipal Structures Act & Section 60 of the Municipal Finance Management Act

ROLE OF THE MUNICIPAL MANAGER

(Section 55(1) of the Municipal Systems Act)

As the head of administration & subject to the policy directions of the municipal council, the municipal manager is accountable & responsible for:
(a) the formation & development of an economical, effective, efficient & accountable administration
(b) the management of the municipality’s administration
(c) the implementation of the municipality’s integrated development plan & the monitoring of progress with implementation of the plan
(d) the management of the provision of services to the local community in a sustainable & equitable manner;
(e) the appointment of staff other than those referred to in section 56,
(f) the management, effective utilization & training of staff
(g) the maintenance of discipline of staff
(h) the promotion of sound labour relations & compliance by the municipality with applicable labour legislation;
(i) advising the political structures & political office bearers of the municipality;
(j) managing communications between the municipality’s administration & its political structures & political office bearers:
(k) carrying out the decisions of the political structures & political office bearers of the municipality;
(l) the administration & implementation of the municipality’s by-laws & other legislation;
(m) the exercise of any powers & the performance of any duties delegated by the municipal council,
(n) facilitating participation by the local community in the affairs of the municipality;
(o) developing & maintaining a system whereby community satisfaction with municipal services is assessed;
(p) the implementation of national & provincial legislation applicable to the municipality;
(q) the performance of any other function that may be assigned by the municipal council.

(2) As accounting officer of the municipality the municipal manager is responsible & accountable for
(a) all income & expenditure of the municipality;
(b) all assets & the discharge of all liabilities of the municipality; &
(c) proper & diligent compliance with applicable municipal finance management legislation.

QUALIFICATIONS FOR MUNICIPAL MANAGERS

A person appointed as municipal manager, or as acting municipal manager must have the prescribed skills, expertise, competencies & qualifications.

MANAGERS ACCOUNTABLE TO THE MUNICIPAL MANAGER

Other key officials in the administration of the municipality are managers accountable to the municipal manager.

Section 56 of the Municipal Systems Act provides for the appointment for managers directly accountable to the municipal manager by the municipal council, after consultation with the municipal manager.
