The Political Party Funding Act introduced regulations relating to the private funding of political parties, including regulating of donations to political parties.In this video, we explain and provide an overview of the Political Party Funding Act 6 of 2018.

The Political Party Funding Act came into effect on 1 April 2021.

The Political Party Funding Act regulates public and private funding of political parties in South Africa.

The Political Party Funding Act establishes funds to provide political parties represented in Parliament and legislatures with funding to undertake their work.

The Political Party Funding Act requires that donations be disclosed by parties and donors to the Independent Electoral Commission (IEC). This includes any donation in kind, but does however, exclude, any Funds provided to the represented political parties by the National Assembly and provincial legislatures, respectively, in terms of sections 57(2) and 116(2)(c) of the Constitution.

The Act prohibits donations to parties by foreign governments or agencies, foreign persons or entities, organs of state or state-owned enterprises.

The purpose of the Political Party Funding Act is, amongst others:
- To regulate the public & private funding of political parties;
- To prohibit certain donations to political parties;
- To regulate disclosure of donations accepted;
- To determine duties of political parties regarding funding; To provide for powers & duties of the IEC;
- To create offences and penalties; and
- To provide for administrative fines.
