The Sad Story of an Injured Worker Who Destroyed Her Own Case

In this video, I give you the sad story of a young lady with a legitimate work injury who ended up with no workers compensation benefits, no job, and a mountain of hospital bills.

Why did this happen? This young woman wanted to protect her job so she told the ER doctor that her crushed hand injury happened at home and not on the job.

She thought that not involving workers compensation was a good idea but her decision turned out to be a disaster. The ER intake nurse and doctor included in their notes that the crushed hand happened at home. And later, when this young lady filed a work injury claim, the insurance company denied it and refused to pay for medical care or to start TTD benefits.

Unfortunately there is not much a lawyer can do to fix this type of problem and I had to decline her case. One of the elements of a compensable workers compensation claim in Georgia is the “arising out of and in the course of employment” requirement. What are the odds that a workers’ compensation judge would find this injury compensable when the injured person told the ER nurse and the ER doctor that her injury happened at home.

The lesson we can all learn from this sad story is that when it comes to work injuries, tell the truth. Yes, you may lose your job if you pursue a #workerscompensation claim - but if you can’t work you will lose your job anyway.
