हेल्सबरी law of England , Oxford dictionaryके अनुसार इसका अर्थ होता है एक दूसरे के विरुद्ध मामला चलाना। एक दूसरे के विरुद्ध मामला चलाने में तीसरे व्यक्ति के विरुद्ध दावे में समाधान हो जाना, सामान्य रूप से दावे में वादी प्रतिवादी के मध्य दावा रहता है। लेकिन इसमें इंटरप्लीडर वादी की संपत्ति के लिए भिन्न दावेदार के विरुद्ध कार्यवाही होतीहै।
उदाहरण के तौर पर ए ने अपना मकान बी को किराए पर दिया और एके सी एव डी बच्चे है, ए ही मृत्यु के बाद सी और डी थर्ड पार्टी के रूप में बी से किराया मांगते हैं ,बी कोर्ट में जाता है ,और सी ओर डी में से किराया किसे देना इस बारे में किराए को सेटल कराता है।

इस प्रकार परस्पर विरोधी दावेदार के बीच विवाद रहता है वादी का संपत्ति में कोई हित नहीं है, खर्चे, परिवादके अलावा कोई इंटरेस्ट नहीं रहता है ऑर्डर 35 सीपीसी प्रतिवादी ने वादी के विरुद्ध यदि दावा पेश कर रखा है, तो न्यायालय सूचना देगा। किसी ने दावा पेश कर दिया है ,क्या उसमें क्लेम कर रहा है, इंटरप्लीडर सूट किराएदार के विरुद्ध और एजेंट को मास्टर के विरुद्ध पेश नहीं कर सकता।
