The Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003 (COTPA)


Prohibits smoking in public places (Section 4).


Defined Public Places


1. Hospitals and healthcare institutions
2. Educational institutions
3. Government offices
4. Public transportation (buses, trains, airports)
5. Restaurants and hotels
6. Public gatherings (movies, sports events)
7. Workplaces
8. Shopping malls and markets
9. Public parks and gardens


Penalties


1. Smoking in public places: ₹200 fine (Section 4)
2. Selling tobacco products to minors: ₹200 fine (Section 6)
3. Advertising tobacco products: ₹5,000-₹10,000 fine (Section 5)


Court Judgments


1. *Murli S. Deora vs. Union of India (2001)*: Supreme Court directed governments to enforce smoking ban in public places.
2. *Ramakrishna Mission Ashrama vs. State of Kerala (2005)*: Kerala High Court upheld COTPA's smoking ban.
3. *G. Krishnan vs. State of Tamil Nadu (2011)*: Madras High Court ruled smoking ban applies to all public places.
