Montville, Ohio -- The Montville Police Department was called to a gas station over reports of a man who allegedly fell asleep in his vehicle and then was swerving all over the road. Police stopped the man, who the officers knew by name.

Eventually they determined that the man was possibly under the influence of alcohol and they asked him to perform some SFSTs. The man didn't do too well on the tests and was taken to the station for processing. He consented to a breath test which yielded a result of .241 % BAC. Legal limit in Ohio is .08, so 3x the legal limit.

The man, later identified as Brad Ostendorf, was charged with the following:
- OVI
- Breath more than .17%

This man, is a Assistant Special Agent In Charge of the USA Environmental Protection Agency, he is considered a federal law enforcement officer. This is the agent's second OVI within 4 months. As a matter of fact, his other OVI case was still pending at the recording of this video. After this OVI he changed his plea to no contest on all charges.

He was sentenced at the same time for both cases which is as follows:
- $1500 in fines
- 12 points
- License suspended for 2 years
- 180 days jail, 170 suspended, 3 days mandatory
- Probation for 1 year

It is unknown to me his employment status with the EPA especially with the his retirement coming within the next year.
