On this, the 18th anniversary of the so-called federal HIPAA "privacy" rule, CCHF's president Twila Brase answers the questions that most people have about HIPAA, exposing the myth that HIPAA protects privacy. HIPAA is actually a "permissive data-sharing rule," explained Brase. This year (2021) is the 25th year of the Health Insurance Portability and Accountability Act of 1996 (HIPAA), which required the "privacy" rule to be written because the law allowed all medical records to be computerized, and made easily accessible, sharable and transferable. But instead the HIPAA rule authorized the sharing and use of identifiable patient data without patient consent.
