An interest in land is synonymous with a right in rem (a proprietary right)

S.33 lists various “excluded interests”, the most significant of which are the beneficial interest under trust (LRA 2002 s.33(a)(i)) and the leasehold estate for a term of three years or less (LRA 2002 s.33(b)(i)). This means all rights in rem (interests) can be registered except the beneficial interest under trust and the leasehold estate for a term of three years or less...
