In this early case on this issue, handed down just a few years after Donoghue v Stevenson, the court found that illegal conduct should not automatically prevent someone from suing in negligence: the law has to expressly state that a person is unable to sue in negligence. However, illegal or just plain silly conduct will often be contributory negligence.
