A letter of protest is an inexpensive trademark enforcement tool that can be used if you find a similar trademark has been submitted with the USPTO for registration.

This formal letter must be submitted within a few months after the other entity’s trademark is filed in order for it to be reviewed by the examiner for the application of concern. If the examiner reads your statement and denies the trademark’s application, you can avoid the costly fees associated with Opposition filings later on.

When submitting a letter of protest, include a short statement of concern and evidence from the marketplace. Keep it less than 75 pages in length and do not include arguments.
