Whenever there are disputes regarding religious places, the place of worship law usually comes in the center of discussion. This time it has also become a matter of discussion because a petition was filed in the Supreme Court regarding the constitutionality of this law. The petitioner claims that this law violates the principle of secularism. In this, the central government has arbitrarily set a non-rational 'cutoff date' i.e., August 15, 1947. Along with this, it has been said in the petition that sections 2, 3, 4 of this law have taken away the right to go to court. Hearing this petition, the Supreme Court has now sought clarification from the Central Government on the Place of Worship Act. In such a situation, in today's article, we will try to know what this law says? Why was it made by Parliament? Along with this, we will also try to understand whether it is unconstitutional.


जब भी धार्मिक स्थलों को लेकर विवाद सामने आते हैं तो उपासना स्थल कानून आमतौर पर चर्चा के केंद्र में आ जाता है। इस बार यह इसीलिए भी चर्चा का मुद्दा बना हुआ है, क्योंकि इस कानून की संवैधानिकता को लेकर सुप्रीम कोर्ट में एक याचिका दायर की गई थी। याचिकाकर्ता का दावा है कि यह कानून पंथनिरपेक्षता के सिद्धांत का उल्लंघन करता है। इसमें केंद्र सरकार ने मनमाने ढंग से गैर-तर्कसंगत ‘कट ऑफ डेट’ यानी 15 अगस्त, 1947 निर्धारित की है। इसके साथ ही याचिका में कहा गया है कि इस कानून की धारा 2, 3, 4 ने कोर्ट जाने का अधिकार छीन लिया है। सुप्रीम कोर्ट ने अब इस याचिका पर सुनवाई करते हुए उपासना स्थल कानून पर केंद्र सरकार से स्पष्टीकरण मांगा है। ऐसे में आज के आर्टिकल में हम जानने का प्रयास करेंगे कि क्या कहता है ये कानून? संसद द्वारा इसे क्यों बनाया गया। इसके साथ ही यह भी समझने की कोशिश करेंगे कि क्या वाकई में यह असंवैधानिक है।
