DISTINCTION BETWEEN ANNULMENT AND DISSOLUTION OF MARRIAGE UNDER THE NIGERIAN LEGAL SYSTEM

There are two ways by which a statutory marriage can be brought to an end under the Nigerian legal system.
Annulment of marriage
Dissolution of marriage or Divorce
A statutory marriage can be said to have been validly conducted if the requisite conditions provided under the Marriage Act have been duly complied with.
However, where the conditions are not complied with the marriage will be invalid or null and void as the case maybe and that would constitute a ground for annulment of the marriage.

In conclusion, if both parties have issues of custody and maintenance of children or settlement of joint property in the two petitions such issues until be taken together in either of the two proceedings.
