The Fair Labor Standards Act (FLSA) contains provisions for minimum wage, overtime pay, and child labor. It applies broadly to employees in the private sector and all levels of government, with enforcement by the U.S. Department of Labor. Only nonexempt employees are eligible for overtime; exempt roles include executive, administrative, professional, computer, and outside sales positions.

The 2004 FairPay Rules clarified that employees earning less than $23,660 annually ($455/week) are entitled to overtime pay, regardless of job duties. Covered employees must receive 1.5 times their regular pay for hours worked over 40 in a workweek. Overtime pay also increases benefits contributions linked to wages, such as 401(k) contributions. A workweek is defined as 168 consecutive hours (seven 24-hour periods), starting any day of the week.

The Portal-to-Portal Act outlines compensable time beyond main job tasks, including short breaks, prep time, and job-related travel—but excludes commuting, like transporting police dogs to work.
