Police report:
“On 6/5/2022, I responded to a construction site in reference to a suspicious individual.

Upon my arrival, Deputy Fitzpatrick and I made contact with Tony, who advised he is currently on a construction job at the location with his son and David (arrestee). The construction site in question is less than one acre in size, and meets the definition of a construction site described in FSS 810,011(13). Tony stated David knew this was a construction site and was even told multiple times when being told to leave the site.

Tony advised David began acting aggressively towards him and his son, which created a well-founded fear for his safety and the safety of his son. Tony stated David was flexing and stating “you better back off” to Tony and his son. Tony further stated he was swinging at people that were not there and yelling at no one.

Tony told David multiple times to leave due to his aggressive behavior and believed David was under the influence of an illegal narcotic. Before Deputy Fitzpatrick and I arrived, David ran into the woodline and in an unknown direction.

Prior to leaving the area, Deputy Fitzpatrick and I canvassed the woodline area. At the woodline, there was a steep 6 foot drop off into Plummers Creek. As we got closer to the creek, we were able to make contact with David on the bank of the creek. As contact was made with Davis, he was advised to come out of the water and speak with us due to his behavior. David jumped in the water stating he needed to cool off and was having an anxiety attack. While speaking with David, his speech was fast paced and jumped from one topic to another. David was extremely argumentative with us and was paranoid he was about to go to jail, even though we never stated he was.

David was given a lawful order to exit the water. David refused and back paddled in the water. David stated he wanted to know why he needed to exit the water. David was again told to exit the water. It was not in the best interest to discuss criminal matters as David was at a point of advantage to swim away and flee from us which would also endanger him due to the swif moving current.

David was instructed multiple times to exit the water and if he continued to ignore lawful deeds, there would be consequences for his resistance.

David continued to swim away with the current to an area Deputy Fitzpatrick and I were no longer able to view from our vantage point. I consulted Sgt. Schmidt to see if there were any additional resources available to assist in locating David and removing him from the water safely.

Sgt. Schmidt requested Marine Unit and Drone Unit to the area David was last seen.

I relocated to the Plummers Creek subdivision kayak boat ramp, where I believed he traveled to. Shortly after, I made contact with David near the boat ramp in the creek and advised David to exit the water again. David responded by asking why he needed to exit the water. Due to my prior interaction and David expressing willingness to once again flee, I advised him I needed to check on his well-being. After much debate, David exited the water, where he was detained and placed under arrest.

Numerous NCSO personnel and physical resources were utilized in the apprehension of David due to his refusal to cooperate with lawful commands given to him. It should be noted NCSO deputies have been dispatched to this area for the same individual multiple times. It should also be noted that during this time frame, the Clay County Sheriff's Office was summoned to the residence of David’s girlfriend, where Davi’s car was parked, to ensure he would not return to her residence due to the fear she was put in by his behavior.

Outside of him being here for this job which he no longer has, David has no known ties to Nassau County.”
