Police Report:

“On 03/12/2022 I, Deputy Bergman, was traveling on Palm coast parkway. I observed a white in color Dodge Ram 1500 traveling in front of me with the hazard lights active. While traveling behind the aforementioned vehicle, I observed the driver of the vehicle swerve into the median, then back on to the roadway. The vehicle continued traveling and shortly thereafter the vehicle struck the median again hitting a curb, causing the left tires to lift off the ground, and cause sparks to come off the rims from the impact. I activated my emergency overhead lights, and the vehicle then began to swerve from lane to lane, eventually coming to a final stop.

I made contact with the occupants of the vehicle, and identified the driver as Amy by her Florida driver’s license. I observed two passengers in the rear seats of the vehicle, later identified as George, and ________ was secured in her car seat, and George was lying on the floorboards. I advised Amy of my reason for the stop, and she began to state she had a lot going on inside of the vehicle. While speaking to Amy, I detected the strong odor of alcoholic beverages emitting from her breath. Amy stated she was coming from a diner in St Augustine, and was dropping off her passenger who was drunk in the rear seat of the vehicle. I noticed Amy’s eyes to be bloodshot and glassy, and she was having difficulty controlling her emotions. Shortly thereafter Deputy Dorsey arrived on scene, and I informed him of my findings. Deputy Dorsey began a DUI investigation, and the scene was turned over to him.

It should be noted, while speaking to George, he stated that Amy had a few drinks tonight. I observed in the rear seat of the vehicle an opened beer bottle, resting near ____ car seat. The liquid inside the beer bottle was cold to the touch. A tow sheet was entered into records. DCF was notified, and responded to the scene to take custody of _____ due to Amy not having any relatives to care for her daughter. “

Deputy Dorsey’s writeup:

“I approached the vehicle on the driver's side. I located Amy in physical control of the vehicle. Amy was crying upon my initial contact with her and upset with her situation. Amy advised she is on the way back from a Hibachi restaurant. Their reservation was at 7pm, they left the restaurant at 9pm, and were stopped by Deputy Bergman 4 hours later.

Amy was asked if she was willing to submit to field sobriety tests to which she agreed. Upon exit the vehicle, Amy stumbled and Amy was read the instructions multiple time and was unable to maintain focus. FSE’s were not completed as Amy was unable to focus and follow instructions. Amy was placed under arrest for suspicion of driving under the influence based off the observations I made up to that point. Amy’s person was searched, which yielded no contraband.

Deputy Priemer, who is a FDLE certified Breath Test Operator, conducted a twenty-minute observation period between 0316 hours and 0336 hours. Deputy Priemer utilized an agency issue Intoxilyzer 8000. Deputy Priemer requested two valid breath samples from Amy, which she agreed to. The Intoxilyzer 8000 provided both valid breath samples as 0.198 and 0.207.

I attempted to read Amy Miranda off an agency issued Miranda card. Amy advised she did not wish to speak to me and would not answer any of my questions.

Let it be know that Amy was driving her vehicle with the above BAC samples, while her three-year-old daughter was in the back seat. Near the three year old daughter was George who was passed out in the back seat, whom later advised Amy had been drinking that night. Also there was a beer bottle stored next to her daughter’s car seat well within her reach. The above circumstances show Amy’s failure or omission to provide care, supervision, and services necessary to maintain the child’s physical and mental health, including but not limited to, food, nutrition, clothing, shelter, supervision, medicine, and medical services that a prudent person would consider essential for the well-being of the child.”
